  1. Definitions
  In these Terms and Conditions, the following terms shall have the meanings set forth below:  
  • Organizer: The legal entity or natural person organizing the event.
  • Participant: Any person taking part in the event as a swimmer, coach, judge, volunteer, or in any other capacity.
  • Visitor: Any person attending the event as a spectator.
  • Personal Data: Any information relating to an identified or identifiable natural person (including, but not limited to, name, address, email, photographs, and videos).
  • Event: The Fryslân Open Synchro Masters Championship, including all associated activities (competitions, training sessions, ceremonies, social events, etc.).
  • GTC: These General Terms and Conditions.
  1. Applicability
2.1 These GTC apply to all participants, visitors, sponsors, partners, and other parties involved in the event. 2.2 By participating in or attending the event, you acknowledge that you have read, understood, and agreed to these GTC. 2.3 The Organizer reserves the right to amend these GTC. Any changes will be announced no later than 14 days prior to the start of the event via the official website and/or email.
  1. Registration and Participation
3.1 Registration
  • Participants must register no later than 31 May 2026 via the official registration form at https://fryslanopen.nl.
  • Registration is only finalized upon payment of the registration fee and confirmation by the Organizer.
  • The Organizer reserves the right to reject or cancel registrations without providing a reason.
3.2 Qualification Requirements
  • Participants must meet the age criteria for (Pre-)Masters swimming.
  • The Organizer may request additional documentation (e.g., passport).
3.3 Cancellation and Refund Policy
  • If a participant cancels by 31 May 2026, 80% of the registration fee will be refunded.
  • If a participant cancels after 31 May 2026, no refund will be issued, unless in cases of force majeure (see Article 10).
  • The Organizer reserves the right to cancel or relocate the event. In such cases, the registration fee will be fully refunded.
  1. Code of Conduct
4.1 Sportsmanship and Respect
  • All participants and visitors must adhere to the code of conduct of the (inter)national swimming federations (KNZB, European Aquatics, World Aquatics) and the venue’s house rules.
  • Discrimination, intimidation, violence, or any other inappropriate behavior will not be tolerated and may result in exclusion from the event without refund.
4.2 Alcohol and Drugs
  • The use of alcohol and drugs is prohibited in competition and training areas.
  • The Organizer reserves the right to deny entry or remove participants or visitors who are under the influence.
4.3 Smoking and Vaping
  • Smoking and vaping are only permitted in designated areas.
  1. Safety and Health
5.1 First Aid and Emergencies
  • First aid services will be available during the event. In case of an emergency, please report to the Organizer or the first aid station.
  • Participants and visitors are responsible for their own health and safety. The Organizer is not liable for injury, illness, or death, unless caused by intentional misconduct or gross negligence on the part of the Organizer.
5.2 Insurance
  • Participants must arrange their own travel and/or sports insurance, covering:
    • Accidents during training sessions/competitions.
    • Medical expenses abroad.
    • Trip cancellation or interruption.
  • The Organizer is not liable for theft, loss, or damage to personal belongings.
  1. Photographs and Video Recordings
6.1 Consent for Recordings
  • Photographs and videos will be taken during the event for:
  • Event promotion (website, social media, press).
  • Archival purposes.
  • Live broadcasts (if applicable).
  • By participating in the event, you consent to the use of your image (photographs, videos) for the above purposes without compensation.
6.2 Exceptions
  • Participants who do not consent to the use of their image must notify the Organizer in writing no later than at the time of registration via info@fryslanopen.nl.
  • The Organizer will make reasonable efforts to exclude such individuals from recordings, but full exclusion cannot be guaranteed (e.g., in group photos or live broadcasts).
6.3 Privacy
  • The Organizer processes personal data (including images) in accordance with the General Data Protection Regulation (GDPR).
  • Images will not be sold to third parties unless explicit consent is given by the individual concerned.
  1. Intellectual Property
7.1 Trademarks and Logos
  • All trademarks, logos, and trade names associated with the event are the property of the Organizer or licensed to the Organizer.
  • Unauthorized use of these trademarks is prohibited.
7.2 Recordings by Third Parties
  • Visitors and participants may take personal photographs and videos for non-commercial use.
  • Commercial use (e.g., sale, publication in media) is only permitted with the Organizer’s written consent.
  1. Liabilitys
8.1Limitation of Liability The Organizer is not liable for:
  • Damage to personal property.
  • Injury, illness, or death, unless caused by intentional misconduct or gross negligence on the part of the Organizer.
  • Delays, changes, or cancellations of the event due to force majeure (see Article 10).
  • Actions or omissions by third parties (e.g., venue, transportation, sponsors).
8.2 Indemnification
  • Participants and visitors indemnify the Organizer against all claims, damages, costs, and legal proceedings arising from their actions or omissions during the event.
  1. Program Changes
9.1 The Organizer reserves the right to modify the program, venue, dates, or other aspects of the event. 9.2 Changes will be announced as soon as possible via official channels (website, email, social media).  
  1. Force Majeure
10.1 Force majeure refers to unforeseeable circumstances beyond the Organizer’s control, including:
  • Natural disasters (floods, storms).
  • Strikes, war, terrorism.
  • Government measures (e.g., COVID-19 regulations).
  • Power outages, technical failures.
  • Illness or death of essential personnel.
10.2 In cases of force majeure, the Organizer is not liable for any damages or costs incurred by participants or visitors.
  1. Applicable Law and Disputes
11.1 These GTC are governed by Dutch law. 11.2 Disputes will first be submitted to the Organizer for amicable resolution. 11.3 If no resolution is reached, disputes will be submitted to the competent court in Leeuwarden.
  1. Miscellaneous Provisions
12.1 Entire Agreement: These GTC constitute the entire agreement between the Organizer and participants/visitors. Oral agreements are not binding. 12.2 Severability: If any provision of these GTC is found to be invalid or unenforceable, the remaining provisions shall remain in full force. 12.3 Language: These GTC are drafted in Dutch & English. The Dutch version shall prevail.
